Terms of Service

Effective date: May 25, 2026

1. Agreement

These Terms of Service ("Terms") govern your access to and use of GreekPad (the "Service"), operated by Greekpad LLC ("we", "us", "GreekPad"). By creating a chapter account, joining a chapter, or submitting any information through the Service, you ("you", "the chapter") agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and a member, officer, or authorized representative of a recognized fraternity or sorority chapter to register an account. You represent that any information you submit is accurate and that you have authority to act on behalf of your chapter.

3. Setup Fee, Testing Mode, and Activation

Access to the Service begins with a one-time, non-refundable (after the refund window described below) setup fee of five U.S. dollars ($5.00)per chapter, charged at the time you complete the chapter reservation flow. Payment of the setup fee creates your chapter account and places it in the state described below as "Testing Mode."

Testing Mode

Upon successful payment of the setup fee, your chapter account is provisioned in Testing Mode. While in Testing Mode, your chapter has access to the internal setup features of the Service, including but not limited to: viewing the dashboard, editing the intake form, importing brother and member rosters, designing chapter-facing pages, and drafting message content. The following features are locked and may not be used while a chapter is in Testing Mode:

  • Publishing the public intake form to PNMs;
  • Initiating or participating in live bid voting;
  • Using presentation mode for in-person voting sessions;
  • Sending SMS messages through the Service;
  • Scheduling SMS messages for future delivery.

A persistent in-app notice will indicate that your chapter is in Testing Mode and will provide a means to activate a paid plan.

Refund Window for the Setup Fee

The setup fee is refundable in full upon written request to reed@greekpad.com within fourteen (14) calendar daysfrom the date the setup fee was charged. Upon issuance of a full refund, the chapter's reservation status is cleared and the chapter reverts to a pre-paid state. After the 14-day refund window has elapsed, the setup fee is non-refundable; however, the $5.00 will remain on your Stripe customer balance and will automatically apply as credit toward your first invoice when you activate any paid plan.

Activation and Paid Plans

To exit Testing Mode and unlock the full Service, you must activate a paid subscription plan. The currently offered plans are:

  • Monthly — $14.99 per month, billed monthly;
  • Semester — $79.00 every six (6) months;
  • Annual — $149.90 per year.

Activation is completed through Stripe Checkout. The $5.00 setup fee that you previously paid will be applied as a credit to your first plan invoice, reducing the amount charged at activation. Upon successful payment, your chapter exits Testing Mode and all locked features become available. Recurring billing for the selected plan begins on the activation date and continues at the cadence of the plan you chose until cancelled. If you obtain a full refund of any plan invoice, the underlying subscription will be automatically cancelled.

We reserve the right to modify the setup fee, plan options, subscription pricing, and SMS credit pack pricing at any time on a going-forward basis. Changes will not apply retroactively to billing periods already paid.

4. User Content and PNM Data

You are solely responsible for any data, photographs, names, contact information, notes, or other content ("User Content") submitted to the Service, including User Content submitted on behalf of PNMs.

You represent and warrant that:

  • You have all necessary rights, consents, and permissions to submit User Content, including any photographs of PNMs;
  • Your use of the Service complies with all applicable laws (including FERPA and student privacy regulations where applicable) and your school's and (Inter)Fraternity Council's policies;
  • User Content is accurate, lawful, and not defamatory, harassing, discriminatory, or hateful;
  • You will not collect, post, or share PNM information without a legitimate recruitment purpose.

You grant GreekPad a limited, non-exclusive license to host, store, transmit, and display User Content solely for the purpose of providing the Service to you.

5. SMS Messaging and TCPA Compliance

GreekPad provides SMS messaging features that allow chapters to send text messages to members and prospective new members ("PNMs"). By using these features, you agree to the following:

Prior Express Written Consent

You may only send text messages through the Service to individuals who have given prior express written consentto receive text messages from your chapter. This is required under the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and applicable carrier regulations. Consent must be obtained directly from each recipient before they are added to any messaging list or sent any message.

What Does Not Constitute Consent

The following do not constitute valid prior express written consent for SMS messaging:

  • A phone number appearing on an IFC-provided list, school directory, or any third-party roster;
  • A person attending a rush event or otherwise interacting with your chapter;
  • A phone number shared verbally or written on paper without an explicit opt-in for texts;
  • Prior consent given to a different chapter or organization.

Your Compliance Obligations

You represent, warrant, and agree that:

  • Every phone number you add to the Service — whether manually, by CSV import, or any other method — belongs to a person who has expressly consented in writing to receive texts from your chapter;
  • You will honor all opt-out requests immediately and not re-add opted-out numbers;
  • All messages you send will include a clear opt-out mechanism (e.g., "Reply STOP to opt out") as required by applicable law;
  • You will comply with all applicable federal and state laws governing SMS communications, including the TCPA, CAN-SPAM Act, and applicable state laws;
  • You will comply with all wireless carrier acceptable-use policies and CTIA messaging guidelines.

Sender of Record; Allocation of Liability

GreekPad is the registered 10DLC sender of all messages dispatched through the Service. Chapters compose message content and select recipients on the GreekPad platform, but GreekPad operates the SMS infrastructure, dispatches messages from its registered carrier-vetted number, captures and stores consent records, and handles STOP/HELP replies and opt-out enforcement.

Chapter responsibility for content and consent. By submitting message content through the Service, you authorize GreekPad to dispatch that content on your behalf. You are solely responsible for (i) the lawfulness, accuracy, and appropriateness of the content you compose, and (ii) ensuring that every recipient on your list has given valid prior express written consent to receive text messages. GreekPad does not independently verify consent for recipients you add manually, import, or otherwise identify; that representation is yours.

Liability allocation. GreekPad expressly disclaims all liability for any TCPA violations, regulatory fines, carrier penalties, or civil claims arising from (i) message content you composed, or (ii) your failure to obtain valid prior express written consent from any recipient. Statutory damages under the TCPA can reach $1,500 per unsolicited message and, where they arise from your content or your consent failures, are your sole responsibility.

Each time you add a contact or initiate a send, you affirm — by checking the required consent checkbox — that you have obtained valid prior express written consent from each recipient. These affirmations are logged by GreekPad and may be used as evidence in any dispute.

GreekPad SMS Program — Terms for Message Recipients

If you provide your mobile number through a GreekPad intake form and check the SMS consent box, you agree to receive recurring transactional and informational text messages from GreekPad on behalf of your chapter, including rush event invitations, chapter announcements, and dues and payment reminders.

  • Message frequency varies.
  • Message and data rates may apply.
  • To opt out at any time, reply STOP to any GreekPad message. You will receive one confirmation message and no further texts will be sent.
  • For help, reply HELP to any GreekPad message, or email reed@greekpad.com.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how we handle your data.
  • Wireless carriers are not liable for delayed or undelivered messages.

Your consent to receive SMS messages is not a condition of using GreekPad or submitting an intake form. You may submit the form without opting in to texts.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful, harassing, or discriminatory purpose;
  • Send text messages to any person who has not given prior express written consent to receive texts from your chapter;
  • Import or add phone numbers from IFC lists, school directories, or any source where the individuals did not directly opt in to your chapter's texts;
  • Attempt to circumvent Testing Mode restrictions, billing, or access controls;
  • Reverse engineer, scrape, or attempt to extract data from accounts that are not yours;
  • Upload malware, illegal content, or content that infringes another party's rights;
  • Impersonate another chapter, person, or entity;
  • Use the Service in a way that violates your school's code of conduct.

7. Intellectual Property

The Service, including all software, branding, logos, and design, is owned by GreekPad and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. All rights not expressly granted are reserved.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violations of these Terms, abuse of the Service, or non-payment. You may stop using the Service at any time. Upon termination, your User Content may be deleted after a reasonable period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEKPAD AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless GreekPad and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict of laws principles. You and GreekPad agree that any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
